Property Sale-Rent Probem 2 - Purchased Shop Lot Problem
New owner purchased a shop lot but the tenant refused to paid rental to new owner. By law the seller should vancant the shop lot before sale it. If the rental amount less then RM5000 the new owner can bring the case to court for judgement without lawyer.
In some cases, if contract did mentioned The subject property will be sold on an "as is where is basis". Mean that the new purchaser will be responsibled to chase the tenant out and any damages on the property was new owner care. Normally if the property sold at below market price will be mentioned "as is where is basis" in the cotract like most of the property sold in Auctions. Very important to consult your lawyer before buy any property to avoid unneccessary problems.
